Service Agreement

PARTIES TO THE AGREEMENT
All persons who are service provider customers and service providers are obliged to comply with the agreement.


1- In case of any action contrary to the LAW OF THE REPUBLIC OF TURKEY on the service provider servers, the services may be suspended without notifying the customer.
2- To internet users with the services provided by the service provider, pornographic materials; It is forbidden to present pirated software, illegal materials (Adult, Warez, Hack, Toplist, mp3 and similar copyrighted (all infringing content) music and image works, Dialer Programs).
3- Service provider; It can suspend services when it detects that the resources such as cpu, ram, disk specified in hosting, reseller and virtual server services are exceeded.
4- The service provider may suspend the service for the health of the system without notice in case of attacks on the hosting and reseller services it provides.
5- Attempting to defame and threaten the Service Provider without proof or evidence; the services of the relevant customer are terminated and the Service provider may claim material and moral rights.
6- It is forbidden to buy reseller hosting for the purpose of hosting sales. Digital Agency and Web Design companies are exempt from this ban.
7- In the detection of any malicious software, services may be suspended without notice, and may be canceled when necessary.
8- It is forbidden to use software with broken licenses and security weaknesses on our servers. In case of damage to the system, the service will be canceled without notice and the customer cannot claim any rights.
9- Services that send heavy packets (attacks, attacks) or behave in a way that threatens the security of any system will be canceled. Likewise, customer service that receives a high-dimensional attack is suspended.
10- The service provider is not responsible for hosting and server management. The service provider is not responsible for all technical processes that are under the responsibility of the customer.
11- Active services will be canceled in any imaginable malicious attempt that will adversely affect the normal functioning of the server.
12- It is forbidden to run any software that communicates with IRC (Internet Relay Chat) networks.
13- It is strictly forbidden to send mass e-mails and SPAM e-mails for any reason. On all services, e-mail services are available for your use only for your regular correspondence.
14- Spam services are canceled as soon as they are detected and the company has the right to demand the damage from the customer.
15- It is forbidden to run file sharing software (example: rapidshare etc.)
16- In VDS services, it is forbidden to use resources that are so intense as to damage other VDSs in any way.
17- The service is suspended without notice in case of attacks against IP addresses different from Hosting or Server services.
18- Customer; If it attempts to change the IP address allocated to it, the service will be canceled. IP changes are made only by the service provider.
19- There is no refund for the services purchased with a campaign and discounted over the normal price; Refund request can only be made with the option of adding balance to the customer account.
20- The unlimited disk option provided in hosting services has been designed according to fair use principles. For this reason, any items other than software files cannot be hosted in the hosting FTP domains.
21- Constantly high CPU consumption cannot be made in hosting services.
22- It is forbidden to run Torrent programs, Mining programs, programs that constantly use CPU and DISK in virtual server services.
23- It is forbidden to use software that "generates intensive Mysql queries". If detected, the service will be suspended.
24- In virtual server services, 2 free formats are granted per month. Extra format is 10 TL including VAT.
25- In the case of CPU usage that will affect the shared server in hosting services, the service is suspended without notice.
26- In hosting services, the free transfer process is carried out only between the currently used panel. We do not transport from external panels.
27- You can request free shipping within 10 days in our hosting services. A maximum of 10 and a total size of 20 GB is provided, provided that the migration is carried out.
28- Our company does not perform backup operations in virtual server and physical server products. In these services, the backup process belongs to the customer. In case of data loss for any reason imaginable, all backup responsibility belongs to the customer.
29- The service provider takes weekly backups of its hosting services. Weekly backup service; It is a free service for the convenience of our customers.
30- Our bank account numbers are registered in our systems. Responsibility for sending money by entering the current account numbers incorrectly belongs to the customer. The service provider cannot be held responsible.
31- If the accounts of our customers registered on the service provider site are stolen, the responsibility belongs to the customer. The service provider is generally responsible for ensuring system security and changing the information of the customer who encounters the related problem.
32- The service provider carries websites up to 5 Gb in hosting services free of charge.
33- Since the hosting management belongs to the customer in our reseller hosting services, our company does not carry out the migration process. Our company reserves the right to provide free transportation to our customers in reseller hosting services.
34- Our customers are responsible for the hosting content created in reseller hosting services. In all negative situations arising from illegal content on any of the sites active on your Reseller hosting service, the responsibility belongs to the service owner.
35- The re-activation of services closed due to spam is 25 TL including VAT.
36- The price increase that will occur as a result of the increase in the domestic and international license prices, electricity and data center costs in the process that you benefit from the service provider services is collected from the customer for the continuity of the service quality.
37- Customer; In case of suspicious transactions made on his account, he is obliged to send the front of the identity card (only the name and surname can be displayed) to the i@starkhost.de e-mail address for confirmation.
38- After the last payment date, the services are kept active for 1 day. It is automatically suspended after 1 day.
39- Hosting services suspended due to unpaid invoices are deleted after 10 days and virtual server services after 2 days.
40- In case of delay in the payment due date for Physical Server services, the service is canceled.
41- We are trying to provide the best service within the framework of the law. The service provider works with an effort to provide trouble-free service to its customers who pay on time.
42- The service provider does not request credit card information through the site.
43- Service provider employees do not request credit card information from any customer.
44- The service provider may accept payment by credit card with the virtual pos systems of intermediary systems.
45- The service provider, your mobile phone number; The customer requests to confirm your account, to send service-related emergencies and notifications.
46- The service provider does not know the private information of its customers. For e-mail or password changes, action must be taken in the account settings.
47- Service provider customers can update their service information at any time. However, general information such as name-surname, address and country information requires the approval of the service provider.
48- The service provider records the IP address of the customer who logs in to the site in order to ensure the security of transaction and privacy on the site. Later, it can remove these records if necessary.
49- Customer; If he forgets his e-mail address, password and security question in any way, he can request the update of his new login information by verifying his profile as specified in Article 4.
50- If the service provider has to confirm the accuracy of the customer records it deems necessary in order to prevent payment fraud and a possible cyber crime, it may request the identity document from the customer to confirm that his profile is real, in order to prove this.
51- The service provider does not keep track of domain name queries made through the site.
52- The service provider, especially from the Turkish users in the individual customer profile, requests the T.C. In addition to contributing to the prevention of possible cyber crimes, the customer must submit his/her name, surname, tax office, account number and identity during the issuance of the INVOICE according to Article 231 of the Tax Procedure Law No. 213. According to the General Communiqué on Tax Identification Number published in the Official Gazette dated 29.04.2006 and numbered 26274, the tax numbers are given by the T.C. It has been converted to an Identity Number, therefore, in the issuance of the invoice, the customer's T.C. Identity Number is also recorded. All individual customers are registered as T.R. It has to report the Identity Number to the Service Provider correctly. Therefore, the wrongly reported T.C. The ID number should be corrected immediately and the Service Provider should be notified. The Service Provider is not responsible for any problems or responsibilities that may occur negatively regarding customers who provide an ID Number. The Service Provider reserves the right to take legal action against the customer and the user due to any problems, troubles and damages that the Service Provider may suffer due to false and invalid information .
53- The service provider has the right to keep all kinds of information belonging to the customer whose service period has expired for as long as it deems necessary. This information is required by the Service provider to support the fight against cybercrimes due to criminal and all kinds of legal problems that the customer has committed or may have committed during the service period. It will be kept for as long as you see it.
54- The customer is freely responsible for legally remedying the victimization and similar negativities he/she thinks he/she has experienced regarding the services he/she receives from the Service Provider. or organizing similar smear campaigns on other platforms, disclosing and disseminating all kinds of technical support correspondence, training topics, price information specially provided by the Service Provider on all kinds of social media, public areas, the Service Provider's site. and if he reads it, he will be deemed to have violated the confidentiality rules accepted by this article.
55- When the customer violates the privacy rules, the Service provider will terminate the service or services it has provided from now on without the obligation to take a backup, and therefore it will not be possible to reactivate the service or services. is not.
56- Customers who receive service from the service provider website cannot organize a smear campaign under their own responsibility (backup, server management etc.) Otherwise, the company will be deemed to have violated the security and confidentiality agreement and an application will be made to the competent Izmir courts.
57- The service provider accepts and undertakes that it will not share the information entered by the customer on the site with third parties. However, if requested by the legal authorities, T.R. Police Departments, Chief Public Prosecutor's Offices and T.C. It can be shared with institutions such as courts.
58- Starkhost; The customer requests their phone number and e-mail address during registration. To its customers through these communication channels; It can inform orally or in writing about possible infrastructure-related developments, invoices, and campaign developments.
59- In the case of sponsored and generally free of charge services, in case of violation of the contract or according to the decision of the service provider; The service provider may unilaterally terminate the service without notice. The control and follow-up of the service belongs to the customer; In any case of violation of the contract, the responsibility belongs directly to the service owner.
60- After the service cancellation, the remaining money is added to the customer account as a credit and this credit cannot be used for domain purchases. The domain name order of the customer who wants to order a domain name with the existing credit is cancelled.

This agreement is valid for our customers who are members of the site and purchase services.
